Representing the Łódź Appellate judges, we demand:
- the immediate reinstatement of Paweł Jusczyszyn, Judge of the District Court in Olsztyn to continue adjudicating;
- the stoppage of all disciplinary activities with respect to judges for issuing judgments, making statements in defence of the independence of the courts and the impartiality of judges, as well as educational activities;
- the fulfilment of the judgments of the Voivodship Administrative Court in Warsaw of 29 August 2018 through the immediate disclosure of the lists of support granted by judges to the judge-members of the NCJ;
- that the judgments of the Polish and European Union courts are respected, in particular the ruling of the CJEU of 19 November 2019, as well as the decision to be issued by the Supreme Court in implementing the guidelines from that ruling.
In view of postulate 4, we refuse to give our opinions on candidates for the Łódź Appellate judicial vacancies until the verification of the independence of the body performing the function of the National Council of the Judiciary from the political authority is completed and we request the President of the Appellate Court in Łódź not to send the candidates for these offices to the Council until all doubts are clarified in this matter.
Until then, we appeal to all Łódź appellate judges to refrain from taking part in the recruitment procedure and to not accept nominations that could be subject to a legal defect.
