The General Assembly of the Warsaw Appellate Judges categorically objects to the activities taken by the Disciplinary Commissioner of the Ordinary Court Judges, Piotr Schab, and his deputies, Michał Lasota and Przemysław Radzik, regarding the judges manifesting their lack of consent to acts that undermine the independence of the courts and the impartiality of the judges.
The activities of the disciplinary commissioners targeted at judges courageously defending the Constitution of the Republic of Poland and opposing actions intended to politically subordinate them are obviously intended to intimidate the whole of the judicial environment.
The General Assembly of the Warsaw Appellate Judges considers it inadmissible for the deputy disciplinary commissioners of the ordinary court judges, judges Michał Lasota and Przemysław Radzik, to establish who the author was of the resolutions passed by the self-governing judicial bodies on the deferral of the provision of opinions on candidates for the office of judge until the doubts are resolved about the legal status of the National Council of the Judiciary, in particular, whether its current members were appointed in a manner that is consistent with the Constitution of the Republic of Poland and the standards of the European Union. Such actions undermine the constitutionally guaranteed independence of the courts, one of the signs of which is the right of the self-governing judicial bodies to speak up in cases regarding the Justice System.
The General Assembly of the Warsaw Appellate Judges obligates the President of the Appellate Court in Warsaw to post the resolution on the website of the Appellate Court in Warsaw and to send the resolution to:
- the First President of the Supreme Court;
- the Presidents of the District Courts and Appellate Courts;
- the Disciplinary Commissioner of the Ordinary Court Judges;
- the National Council of the Judiciary;
- the Minister of Justice.
