We urge you to immediately take advantage of the rights specified in Article 130 of the Act on the System of Ordinary Courts and order the Minister of Justice to dismiss the group of judges engaged by the Ministry of Justice, who are responsible for the probable crimes against around 20 judges, including Regional Court Judge Krystian Markiewicz, which have been described in Onet’s publications from their official duties, or to order the immediate suspension from the performance of their official duties, for the good of the Republic of Poland and in the interests of maintaining the constitutional order in Poland.
It has transpired today that further judges working at the Ministry of Justice are involved in the criminal practice and perhaps also the disciplinary commissioners appointed by the Minister of Justice.
All these people are connected to one person, namely the Deputy Minister, District Court Judge Łukasz Piebiak, who managed the special group at the Ministry of Justice responsible for the preparation of the tactics of disciplinary proceedings against judges. There are many signs that the results of this group’s work is the hateful KastaWatch portal on Twitter, where documents from personal files of judges and files of disciplinary proceedings are illegally posted, even though they are subject to personal data protection.
We believe that, without a reliable investigation, in which the computer hardware and telephones of the group of judges from the Ministry of Justice involved in the defamation and publication of personal data are immediately secured, this appalling case cannot be clarified. Only your immediate intervention can prevent the evidence from possibly being destroyed and the traces of the doubtless criminal activity taking place at the Ministry of Justice being concealed.
In the interests of the image of the justice administration, which has never been as threatened by a group of judges from the Ministry of Justice since 1989, we simultaneously request the suspension of the activities of all the presidents of the courts appointed by Regional Court Judge Łukasz Piebiak under an interim regulation amending the Act on the System of Ordinary Courts, which entered into force on 12 August 2017. These people were appointed to the positions of presidents of the courts only because of their personal connections with Mr. Łukasz Piebiak, whose moral mandate for these activities, as the recent events show, was and currently is questionable.
Mr. Prime Minister, the responsibility of the Minister of Justice for all the above events is also in your hands. The fact is that this is a political responsibility, although the records of the conversations between the officers of the Ministry of Justice with the haters, which are not denied by the suspects themselves, suggest that the Minister of Justice himself could have known an accepted the whole of the procedure.
We demand urgent and real action on this matter. The combination of the functions of Prosecutor General and Minister of Justice gives no guarantee that the Minister will realistically clarify the matter, which applies directly to him.
In this situation, one real method of reliably clarifying the matter is to appoint a parliamentary inquiry commission to investigate the possible involvement of other officials of the Ministry of Justice in this criminal activity.
