The General Assembly of the Judges of the Gorzów Region expresses its gratitude to all citizens who, together with the judges, Polish and foreign legal corporations, non-governmental organizations and the Polish Ombudsman, stand in defence of the Constitution of the Republic of Poland, the sovereignty of the courts and the independence of the judges. Furthermore, the Assembly:
- Solidarizes with the judges of the Supreme Court, the Kraków, Warsaw, Łódź and other regions in their endeavours to ensure the correct functioning of a justice system, which is consistent with the Constitution, independent of the political authorities, based on democratic foundations and values and generally accepted in the European Union. As part of these principles, there must be an assurance that the courts are managed by people with appropriate competence and experience, respecting the principles of cooperation with the court authorities and judges, as well as the right of judges to express their own views and opinions, also being independent of the political authorities.
- Opposes the intimidation by politicians (including by those who are members of the body referred to as the National Council of the Judiciary) of judges conscientiously adjudicating and performing their duties, insinuating that they may be subject to disciplinary action for decisions made by the courts on the basis of the provisions of the law.
- Calls on all judges in Poland not to succumb to the pressure and attempts to intimidate and exert pressure on them, while calling on the self-government of judges to take an unequivocal, determined stance opposing all actions intended to subordinate the courts to the political power.
- Objects to the attitude of the judges who are members of the body referred to as the National Council of the Judiciary, considering this as being unworthy of the judge’s office they hold, especially because of the actions taken by the current National Council of the Judiciary focusing on intimidating judges through disciplinary action and repression for alleged political involvement for speaking publicly in defence of the sovereignty of the courts and judicial independence and passing judgment in accordance with applicable law, which is not always accepted by the politicians.
- Expresses its solidarity with the judges who are subjected to criticism and pressure in connection with judicial activities, identifying themselves in this matter with the resolutions passed by the self-governments of judges throughout Poland, as well as foreign and international bodies and institutions.
- Expresses its objection to the attacks by politicians, which have lasted almost three years, including through the use of the media, boiling down to a series of slanders, insinuations and false allegations with respect to the judges, including the judges of the Supreme Court who, in accordance with the sworn oath, faithfully serve the Republic of Poland, in fulfilling their duties conscientiously and impartially, protect the law and criticize the actions of the political authority in breach of these laws.
- Objects to the actions of the body called the National Council of the Judiciary with regard to the non-transparent and unreliable progress in selecting candidates as judges of the Supreme Court and the ordinary courts, leading to the recommendation of people with dubious legal knowledge, connected with the executive power or having been subject to disciplinary action, who therefore do not offer any guarantee of objectivity, independence or sovereignty in their adjudication.
