We, the undersigned judges of the Supreme Court, declare that the position of the current management of the Supreme Court presented by its press officer, Aleksander Stępkowski, from which it arises that the Supreme Court will seek to have the Polish government file a motion to the Grand Chamber of the European Court of Human Rights to reconsider the case of M. Dolińska-Ficek and A. Ozimek v Poland, which ended in the judgment of the European Court of Human Rights of 8 November 2021, no. 49898 and 57511/19, is not the position of the Supreme Court.

Although Judge Małgorzata Manowska was appointed to head the Supreme Court and to represent it externally (Article 14 § 1 of the Act on the Supreme Court of 8 December 2018 – consolidated text Dz.U.2021.1904), the appropriate bodies appointed to speak out on the matter encompassed by the press officer’s statement, including, primarily the General Assembly of Judges of the Supreme Court (Article 17 § 1, item 4 of the Act on the Supreme Court cited above), which has not been convened to date since its adjournment on 12 June 2020, and which has the exclusive competence to pass resolutions on other important matters regarding the Supreme Court, have not addressed this matter.  The above position expressed by the press officer only presents the views of its authors, who are personally interested – because of their status – in the outcome of the proceedings before the European Court of Human Rights, and not the views of the Supreme Court as a constitutional body.
