Themis Association of Judges, with embarrassment and indignation, accepted the announcement of the Disciplinary Commissioner of the Ordinary Court Judges Piotr Schab of 28 August 2019 about the initiation of disciplinary proceedings against the judges Olimpia Barańska – Małuszek and Waldemar Żurek, in connection with statements on the subject of „Piebiak scandal” and instrumental treatment of the way of constitutional control.
It is a paradox that Waldemar Żurek and Olimpia Barańska – Małuszek, who were among the most slandered judges by the KastaWatch portal inspired by the Ministry of Justice, are now being hunted by the Disciplinary Commissioner Przemysław Radzik, who in the light of media reports had a relationship with people who inspire hate in the Internet. In this way, victims become accused and potentially suspects become victims and prosecutors.
The hit on victims of crime is a negation of an attempt to explain the modus operandi of offenders, on the contrary – it aims to hide the perpetrators and divert public attention from them. It is also about gagging the mouth of defiant judges who talk loudly about pathologies in the Ministry of Justice.
We firmly declare that the views expressed by the judges, Olimpia Barańska – Małuszek and Waldemar Żurek, are shared by a significant number of judges and this cannot be changed by any bizarre messages.
Once again, we demand immediate suspension in the performance of the duties of persons who, in the light of media information, participated in the Kasta discussion group, including Przemysław Radzik and Michał Lasota, and take real investigative measures to clarify their role in the Piebiak affair.
We urge all judges to support the harassed judges Waldemar Żurek and Olimpia Barańska – Małuszek, and to object to the further performance of duties by those involved in this scandal.
